Charter Service Agreement
3D Jets, LLC is a certificated Part 135 charter operator, with its base of operations located at the Buffalo Niagara International Airport (KBUF) in Buffalo, NY.
This agreement sets out the general terms and conditions for the charter service and in accordance with all applicable Federal Aviation Regulations. Upon either signing the quote page or making payment in full for charter services, the Customer agrees to and is bound by all terms within this contract.
Charter Price:
The Charter Quote for each trip shall set forth the the charter price and any associated costs and expenses. Customer shall be responsible for additional charges incurred by 3D Jets and will be billed separately for such costs and expenses (if not known at time quote is executed) such as catering, ground transportation costs, de-icing costs and weather-related delays or diversion expenses. Payment must be completed before charter can be confirmed.
Early Termination (Flight Cancellation Policy):
A $1250.00 non-refundable cancellation penalty applies to entire quote upon booking to trip. Additionally, the following cancellation fees will apply:
If Customer cancels within 72 hours or less of a trip a 25% cancellation fee will be charged. If 48 hours or less of a trip a 50% cancellation fee will be charged. If Customer cancels with less than 24 hours notice or a no-show a full 100% penalty will result.
Positioning Legs:
Any positioning legs are the property of 3D Jets and cannot be sold, occupied, or utilized by the client unless specifically stated by 3D Jets.
Passenger Manifest:
Booking Customer is responsible for informing all passengers that prior to boarding the aircraft they must show at least one form of valid state/government issued photo identification to pilot/operator of the flight.
Baggage:
3D Jets is not responsible for the arrangement or payment for shipping excess baggage. If traveling with large items such as golf clubs, this should be discussed at time of quote to be sure there is adequate room for such items. If any baggage or container
is fragile, Customer is responsible for it being properly packaged and labeled and notify the flight crew of such.
Passenger Conduct:
In the event that a passenger’s conduct, behavior or health is deemed by the captain of the Aircraft to cause discomfort or jeopardize the safety of the passengers and/or aircraft, then the captain of the Aircraft shall be entitled to take any action deemed necessary to procure the safety of the passengers and Aircraft including, but not limited to diverting or returning to the airport of departure and/or removing the passenger(s) in question. If such action is deemed necessary, Customer shall compensate 3D Jets against any loss incurred as a result of such diversion and removal.
Cleaning/Restoration Charges:
Customer will be responsible for any and all cost of cleaning, restoring and /or repairing damage beyond normal wear and tear to the interior of the aircraft caused by Customer or Customer’s guest. Smoking on the aircraft is prohibited.
Weapons:
No weapons are permitted aboard 3D Jets’ aircraft unless prior permission is given by the Director of Operations and/or the Chief Pilot. Firearms must be unloaded, and kept inside a hard-sided, lockable gun case. Firearms/gun cases will be stored in the exterior baggage compartment, with no passenger access. If a firearm/gun case must be stored in the passenger compartment, a trigger lock (provided by 3D Jets) will be used, and the keys will remain with the captain for the duration of the trip. No ammunition may be carried aboard 3D Jets’ aircraft, and must be purchased by the passenger at the destination.
Prohibited Items:
Passengers have the responsibility to comply with Transportation Security Agency (TSA) and Federal Aviation Administration (FAA) regarding prohibited items. For the full list visit www.tsa.gov/travelrs/airtrave/prohibited/permitted-prohibited-otems.shtm and http://www.faa.gov/go/packsafe Examples include fireworks, flammable liquids, gels or aerosols, as well as items with lithium battery powered products, scuba equipment (bottles of compressed air), medical oxygen tanks, and e cigarettes and vape pens in stowed luggage.
Force Majeure:
3D Jets, LLC shall not be held liable for loss, injury, damage, delay or cancellation caused by or resulting from any act of God, explosions, revolutions, acts of terrorism, hijacking, insurrection, riot, civil commotion, war, national or local emergency, act of government, lock-out, strike, industrial dispute or action, fire, lighting, embargoes, quarantine requisition of an aircraft or cargo, or extreme weather conditions.
Termination of Agreement/Limitation of Liability:
Either party may terminate this contract at any time with written notice. The customer is obligated to pay any amounts due to 3D Jets per the early termination agreement. Should there be a mechanical breakdown that cannot be addressed in time for the scheduled flight, a replacement aircraft will be sought by 3D Jets for
the Client. Should the Client not find the replacement aircraft suitable, they have the right to cancel the charter trip without penalty.
Arbitration:
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar service selected by the parties, in the state of New York. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
